my sympathies to the family

1. the city needs to reduce the speed limit on that road, no suburban back-road should be 40mph

Two. they need to setup a speed trap to retrain all the drivers going down that road

Trio. they need to setup a bite operation with a pedestrian crossing the road, if people whiz past them then that’s a ticket for not yielding and most likely another for speeding.

Four. they need to setup automatic lights on that crosswalk that light up the entire sidewalk when people are crossing.

The City? How is the city responsible for people’s neglagence? Both the driver and parent are at fault! The driver for not stopping at the crosswalk and the parent for not making sure the driver stopped before crossing. They both have an obligation. This crosswalk has a button to make the flashing lights come on before crossing. The automatic lights are a problem because the will trigger for false crossings making drivers disregard them. 40mph is good for this road because it’s an arterial connected to a state route. If motorists would go after the posted speed limit it would be okay. The problem is people often travel this road at 50+! The city did a good job by installing those shove button actuated flashing crosswalk signs. The city should be commended for that. You should have seen it before! My thoughts and prayers go out to this child and family.

A pedestrian in a crosswalk has unconditional right of way if an approaching vehicle has adequate stopping distance. The pedestrian is NOT required to wait for the vehicle to stop under those conditions. Also, the driver has a moral responsibility to be observant and aware of any children in the surroundings that could run out into the street.

True but that doesn’t matter if you’re dead! I trained my daughter to make eye contact with the driver of stopped cars to ensure that the driver is actually eyeing her. Drivers who are about to make a right turn on a crimson are looking left for a break in the traffic. They’re not looking to the right where a pedestrian could be crossing. It’s about using your brains and not arguing about laws.

I agree forty mph is good for this road (I live right by the zoo). It used to be fifty mph about fifteen years ago.

Anything lower, like thirty mph, would be much too slow.

Like you said, the problem is that it isn’t enforced. Some people go sixty and come up behind you real quick (which gargles when slowing down to turn onto the zoo road). Others scarcely go thirty and create a backup.

NOMOOR, It’s not about law. It’s about life. That’s what’s wrong with people in this state. Just because you have the right of way it doesn’t mean you just walk out blindly without making sure the vehicle is stopping. Sure you have the right of way, but it won’t matter when your dead! My life and my kids life’s are worth more than a right of way. Everyone should learn from this.
